  • You can plant a tree in their memory. You can find tree seedlings on the internet. You could also buy a tree at a local nursery.

  • Start a college scholarship in their name.

  • Keep a journal of your memories, your thoughts and what you learned from your loved one.

Whatever the occasion may be - be it to share our greatest joys or express our deepest sorrows, flowers are most commonly used to represent our feelings. The formation can go as a single stem or a bouquet; these flowers, which are available in a variety of shapes, sizes, colors and fragrances, can be arranged to express almost every sentiment.

History supports the long path flowers have traveled in expressing feelings. The passion for flowers was so high with the French that they even published flower dictionaries in 1800s. This helped them classify and use almost all available flower species. The significance of a single flower such as a marigold was so high that its direction in a bouquet defined jubilation or a mourning.

Today, gifting flowers is not simply considered a kind gesture, but in many cases a hard-and-fast rule. Flowers of various types have become seamlessly integrated necessities in many of our most important life rituals, including birth, marriage, and death. If a flower or an arrangement speaks to you then perhaps bright colors best establish your happiness on success at professional level or a promotion while a single lily may remind you of someone loved at home even though it is normally considered a funeral flower.

Military Funerals

In the US, a military funeral is given by the armed forces for a war veteran, a soldier who died in battle or a prominent military figure. The Department of Defense, or DOD, is usually responsible for providing military funeral honors or the title “Honoring Those Who Served” to the deceased.

Section 578 of Public Law 106-65 of the National Defense Authorization Act mandates that the U.S. military must provide the rendering of U.S. military funeral honors for an eligible veteran upon a family’s request. Those who are eligible for a U.S. military funeral include military members on active duty or in the Selected Reserve, former military members who served on active duty, former military members who completed at least one term of enlistment or a period of initial obligated service in the Selected Reserve, and former military members discharged from the Selected Reserve due to a disability incurred or aggravated in the line of duty.

A military funeral usually includes all or some of the following features, depending on the status or the deceased. The coffin of the deceased is traditionally draped in a U.S. flag, and at the time of burial the flag is folded and presented to the next of kin as a keepsake. The flag is provided by the U.S. Veterans Benefits Administration without any cost, and is draped around the casket or accompany the urn of a deceased soldier. During the funeral procession, a horse-drawn caisson sometimes transports the coffin. Usually, cannon fires or gun salutes accompany a military funeral for high-ranking officials. A military bugler play taps at a distance of 30 to 50 yards from the gravesite, and sometimes a fly-by by military jets is performed for flyers and General Officers of the USAF.

A military funeral honors a war veteran, soldier who died in battle or a prominent military figure, and fills the hearts of their immediate family member with pride for the deceased.

Buying life insurance when you are a senior used to be a hard thing to do, but now there are many companies that offer Guaranteed Acceptance Life Insurance to people who would not otherwise be able to buy life insurance due to their age, health or financial situation. With Guaranteed Acceptance Life Insurance there is no physical exam requirements or questions about the applicants health. These plans usually have a limited benefit period. If the death of the policyholder occurs in the first few years a reduced benefit is paid, or the insurance company returns the premiums already paid with the accumulated interest. This is how insurance companies are able to guarantee acceptance.

There are a few disadvantages to guaranteed life insurance. Most of these types of policies are designed to provide only funeral expenses, so most do not sell policies with a benefit value of more than $15,000 to $20,000. If you can get traditional insurance you will most like pay much less for a greater amount of benefit than if you had bought guaranteed issue life insurance. If you have been turned away from every other policy because of health or age, guaranteed life insurance is a good option, but it should not be your first. Talk to a financial advisor and see if a savings or investment plan would be a better option.

When Grandma is Dying - What to Do With the Young Children

When Grandma (or anyone else close) is dying we need to consider the children’s lack of sophistication about death. But children know more than we think and know it sooner than we realize. It is best to let them in on what is going on in the household to the degree that they can understand. If you conceal the truth, it only teaches them to do the same and that you don’t have faith in them. When they are very young they need to cope on a fantasy level. They are glad to hear stories which they can feel a part of. Stories about make-believe are fine, but not to deceive them, just to distract and comfort. Always answer their questions as honestly as you can. If you don’t know the answer, say so.

By age seven they are finished with pre-school and kindergarten and have negotiated the world of the school yard and the neighborhood and have a lot more savvy than we may believe. Even so, they need to be spoken to with care. No need to be sentimental about it, but show as much warmth and love as possible so they feel secure. Holding them and rocking is very beneficial. It can help children to deal with human mortality if you talk about the life cycles of plants and animals. They will have had experience with seeing plants die and probably animals, and will surely have seen movies in which animals die. It is worthwhile to help them to realize that our grief is for ourselves because we don’t have that wonderful person in our lives anymore, not for the dead person who is beyond awareness. Don’t be afraid to laugh and make them laugh.

While she is alive, have the children start a scrapbook with pictures of them and Grandma together. Have them draw pictures of Grandma as they remember her earlier and as she looks now. Have them write stories about the past with Grandma and where they think Grandma is going. Have them make a greeting card every day and have them present it to her. Save the cards for the scrapbook. Take pictures of the presentation. Grandma smiling is a wonderful keepsake.

Make a recording of Grandma’s voice; take a movie with her and the children if you can. Encourage them to sit and play quietly near her when she is sleeping. Ask them about their dreams every morning. Have them make a banner saying WE LOVE YOU GRANDMA to hang in her room.

They may want to see her body in the casket. You will need to exercise judgment about that. It can be traumatic or it can be comforting. Consider the children’s relative vulnerability. Include them as much as possible in the funeral and the activities afterward. Give them tasks so they feel that they have made a contribution.

Children often feel guilty about the death of a close one, as if they were somehow responsible for the death. Assign them some responsibilities of a ceremonial or ritual nature such as lighting candles, singing a song, creating a shrine. The more they participate in the last months and days, the more they will be able feel that they did their best and they will have memories to cherish and less guilt to worry about.

Public Speaking and Panic Attacks

It is often observed that many people’s top ranking fear is not death but having to speak in public. The joke is that these people would rather be lying in the casket at the funeral than giving the eulogy. Public speaking for people who suffer from panic attacks or general anxiety often becomes a major source of worry weeks or even months before the speaking event is to occur.

These speaking engagements do not necessarily have to be the traditional “on a podium” events but can be as simple as an office meeting where the individual is expected to express an opinion or give verbal feedback. The fear of public speaking and panic attacks in this case centers on having an attack while speaking. The individual fears being incapacitated by the anxiety and hence unable to complete what he or she is saying. The person imagines fleeing the spotlight and having to make all kinds of excuses later for their undignified departure out the office window….

This differs slightly from the majority of people who fear public speaking because their fear tends to revolve around going blank while speaking or feeling uncomfortable under the spotlight of their peers. The jitters or nerves of speaking in public are of course a problem for this group as well, but they are unfamiliar with that debilitating threat which is the panic attack, as they most likely have not experienced one before.

Public Speaking and Panic Attacks
So how should a person with an anxiety issue tackle public speaking? Stage one is accepting that all these bizarre and quite frankly unnerving sensations are not going to go away overnight. In fact, you are not even going to concern yourself with getting rid of them for your next talk. When they arrive during a speech/meeting, you are going to approach them in a new manner. What we need to do is build your confidence back to where it used to be before any of these sensations ever occurred. This time you will approach it in a unique, empowering manner, allowing you to feel your confidence again. It is said that most of the top speakers are riddled with anxiety before speaking, but they somehow use this nervousness to enhance their speech. I am going to show you exactly how to do this, although I know that right now if you suffer from public speaking and panic attacks you may find it difficult to believe you can ever overcome it.

My first point is this and it is important. The average healthy person can experience an extreme array of anxiety and very uncomfortable sensations while giving a speech and is in no danger of ever losing control, or even appearing slightly anxious to the audience. No matter how tough it gets, you will always finish your piece, even if at the outset it feels very uncomfortable to go on. You will not become incapacitated in any way.

The real breakthrough for if you suffer from public speaking and panic attacks happens when you fully believe that you are not in danger and that the sensations will pass.

“I realize you (the anxiety) hold no threat over me.”

What keeps a panic attack coming again and again is the fear of the fear—the fear that the next one will really knock your socks off and you feel you were lucky to have made it past the last one unscathed. As they were so unnerving and scary, it is your confidence that has been damaged by previous anxiety episodes. Once you fully understand you are not under any threat, then you can have a new response to the anxiety as it arises while speaking.

Defeating public speaking and panic attacks...

There is always a turning point when a person moves from general anxiety into a panic attack, and that happens with public speaking when you think to yourself:

"I won’t be able to handle this in front of these people."

That split second of self-doubt leads to a rush of adrenaline, and the extreme anxiety arrives in a wave like format. If, however, when you feel the initial anxiety and you react with confidence that this is not a threat to you, you will move out of the anxiety rapidly. Using this new approach is a powerful ally because it means it is okay to feel scared and feel the anxiety when speaking–that is fine; you are going to feel it and move with and through the sensations in your body and out the other side. Because he or she is feeling very anxious, often before the talk has begun, that person may feel they have already let themselves down. Now, you can relax on that point. It is perfectly natural to feel the anxiety. Take for example the worst of the sensations you have ever experienced in this situation—be it general unease to loss of breath. You will have an initial automatic reaction that says:

“Danger–I’m going to have an episode of anxiety here and I really can’t afford that to happen.”

At this point most people react to that idea and confirm it must be true because of all of the unusual feelings they are experiencing. This is where your thinking can lead you down a train of thought that creates a cycle of anxiety that produces a negative impact on your overall presenting skills.

So let that initial “oh dear, not now” thought pass by, and follow it up immediately with the attitude of:

“There you are–I’ve been wondering when you would arrive. I’ve been expecting you to show up—by the way, I am not in the least threatened by any of the strange sensations you are creating—I am completely safe here.”

Public Speaking and Panic AttacksThe key to controlling your fear of public speaking and panic attacks is that instead of pushing the emotional energy and excitement down into your stomach, you are moving out through it. Your body is in a slightly excited state, exactly as it should be while giving a speech, so release that energy in your self-expression. Push it out through your presentation not down into your stomach. You push it out by expressing yourself more forcefully. In this way you turn the anxiety to your advantage by using it to deliver a speech where you come across more alive, energetic and in the present moment. When you notice the anxiety drop as it does when you willingly move into it. Fire a quick thought off when you get a momentary break (as I am sure you have between pieces), asking it for “more.” You want more of its intense feelings as you are interested in them and are absolutely not threatened by them.

It seems like a lot of things to be thinking about while talking to a group of people, but it is not really. You’d be amazed how many different non-related thoughts you can have while speaking. This approach is about adopting a new attitude of confidence to what you might have deemed a serious threat up until now. This tactic will truly help you with fear of public speaking and panic attacks you have associated with them.

If your predominant fear of the speaking engagement is driven by a feeling of being trapped, then I would suggest factoring in some mental releases that can be prepared before the event. For example, some meetings/speeches allow for you to turn the attention back to the room to get feedback etc. from the group.

If possible, you might want to prepare such opportunities in your own mind before the engagements. This is not to say you have to ever use them, but people in this situation often remark that just having small opportunities where attention can be diverted for the briefest of moments can make the task seem less daunting. It my even be something as simple as having people introduce themselves or opening the floor to questions. I realize these diversions are not always possible and depend on the situation, but anything you can factor in that makes you feel less trapped or under the spotlight is worth the effort and can help alleviate fear of public speaking and panic attacks.

Now does everyone have fears? We do. Now here is the interesting thing. A little baby that is a week old, just born only has two fears: the fear of falling and the fear of loud noises.

Some people like to take the word fear and spell it out, like False Expectations Appearing Real, some say it is forget everything and run. I think it is Frozen Energy Actions Required. So the challenge is that we've learned these fears, and so if we can learn them we can unlearn them. It is a challenge, we have on of the big fears that Napoleon Hill even talks about is the fear of criticism. Why do we care so much what people think? Social acceptance? We want to be accepted?

Esteem acceptance and praise is one of our deepest cravings. I've done seminars all over the country and as you speak to people, 50-60 people come up and say “thank you, that was great, I appreciate it.” But there is always that one person that has something negative to say, so the ratio is 50:1 but what is on my mind? That one person. What about the other 50? For example a dance instructor was teaching a lady who always wanted to dance and had saved up her money and on her first lesson, the dance instructor said, "Man, you dance like a hippo." What happens to that lady? Does she ever try it again? She is gone.

When in reality, if you look at some of the famous musicians, they've had instructors say that to them, but they didn't listen to them, but the majority of people do listen to them, they have this fear of criticism, they want to be accepted. Fear is one of those things that we really need to take a look at. If you take a plank and put it on the ground and walk across it, there is no fear, but all the sudden, if you put it up on a 20 story building, and you have to walk across this plank between two buildings, it is the same thing, you know you can do it, but you still feel the fear. For example, public speaking, is that a big fear among people? Why? It is a learned fear, where did we learn it? At school? Somebody laughed and what did we think? They are laughing at us.

I teach students and one of the courses I teach at the University is Public Speaking and one of the first things we have to deal with is the fear in getting out and doing it. In fact, one of the funny things that Jerry Seinfeld says is that one of the biggest fears is public speaking and public speaking is a greater fear than dying. And so he says people at the funeral would rather be in the casket than giving the Eulogy. It doesn't make a lot of sense. We have to look at one of the triggers of your fears. Where do they come from? Whether it's spiders or snakes or monsters under the bed. That is the thing. I'm not talking major psychosis or major fear, I'm just talking about minor fears that we have to get over and one of the biggest things they talk about of course is looking fear in the face. Getting out there and doing it. Have you ever had an experience where you were so scared to do something and then you went and did it and what was the first thing you thought of? That's right, that it wasn't so bad. We spend all this time worrying about it and the most important thing is to identify that trigger and understand where that fear comes from and get past them.

Like again, the fear of criticism, when you look at the fear of criticism, Napoleon Hill says it robs man of initiative, destroys his power of imagination, limits his individuality takes away his self reliance and does damage in 100 other ways. In a world bent on acquiring ever more knowledge being referred to as being intelligent has supplanted the idea of a moral and decent life. I attended a funeral where the deceased was known for having been a cranky, ungodly, unloving man throughout his entire life. I thank God I wasn’t asked to give the eulogy. The person that had to deliver the eulogy was hard put to find a decent word to say about the deceased. I will never forget the single word he was able to find in praise for decedent. He said “he was as we all know, a very intelligent man.”

While being intelligent has never been a requirement for entering the kingdom of God it is also not required for interpreting the scriptures or the exposition of biblical prophecies. That does not mean that it is left to the ignorant to tell what is in the scripture. It is the believing and faithful alone that are allowed to see what the word of God is saying. Jesus said the Pharisees heard what he was saying but because they chose not to believe it, its truth was concealed from them regardless of their intelligence. Calling on the views and comments of unbelieving doctors of divinity and TV and Hollywood puppets, they managed to raise more questions than they answered. Although not a laughing matter it seemed as if they were getting their best answers from Dr. Twiddle D.D. and Rufus T. Firefly. I think it’s safe to say that the apostles, prophets and certified bible preachers in any generation are far more believable than those the history channel chose to speak for them.

Before Christ was born in Bethlehem King Herod wanted to know where he was to be born. He asked his scribes and priests who after checking the writings of the prophets they informed Herod that he would be born in Bethlehem of Ephrata. Two amazing things can be learned from this little bit of scripture. First, what could be known about Christ’s first coming was readily available through prophecies contained in scripture. The second was that this knowledge was used to perform one of the bloodiest child massacres in the history of the world.

Nothing much has changed over the years. All that can be known about Christ’s second coming can still be found in the scriptures. And for those who are unbelieving and evil that knowledge will be scoffed at or misused to conduct themselves and others to their own inevitable judgment.

However, most companies will charge higher fees when you include mortgage in your life insurance policy.

Some companies consider mortgages in different light. For example, if you have “Interest Only Mortgage” loans then you will need “Level Coverage Life” policies, since you will need a ‘fixed and constant’ cash assurance. The reason for this is that the Interest Only loans allow the buyer to payoff the interest first and then the capital later. The Level Coverage Insurance pays off the capital on the mortgage, thus since the buyer is only paying interest now the capital later will be much higher. Therefore, the company will charge higher premiums likely, since the money applied to your life insurance is the sum you will receive if you should die. Therefore, the company (when mortgage is involved) is paying for burial plus mortgage. If you have a mortgage and a spouse joining you in the purchase of the home, then you want to consider a Joint Plan, since this will lower your premiums slightly.

Of course, if you or your spouse is under the Rated Premium plans then the premiums will go up. One of the disadvantages of Joint life coverage is that the term is obsolete once the first party dies. Thus, the plan is often called “First Life” since it will cover one or the other in the event a policyholder dies. Therefore, if the spouse does not have a single policy when the first policyholder dies, he/she will not have coverage and it could lead to bigger problems since the person may not be able to get coverage later.

Still, if the second party were able to get coverage, the person would pay higher premiums most likely. Finally, if you have mortgage to consider you may want to consider taking out Critical Ill or Terminal Ill coverage, since this will provide additional coverage when the inevitable occurs. Furthermore, it might be in your best interest to take out separate policies, rather than joint policies, since you may pay more now, but you and your spouse will not suffer later.

A will should be made when a person is legally competent, having a sound mind and at least 18 years old. It should be prepared while its maker is in good health and free from emotional stress. In other words, to make a valid will, people must understand things such as what property they own, its value, and whom they are leaving it after their death.

A person does not need to have a large estate to plan and prepare a will. Anyone who owns property, including cash, stocks, jewelry or furniture, or real property, such as land or house, could prepare a will. If married, each spouse should have a will indicating the ownership and transfer of property.

In addition to distributing or transferring of property, a will should have other functions. It may be used to name a guardian for any minor children or to create a trust and designate a trustee to handle an estate (property left after death) on behalf of children or others. A will may also be used to name a personal representative or an executor to handle a decedent's property and affairs from the time of death until an estate is settled.

When there is no valid will, the person is said to have died intestate. A court appoints an administrator to handle the decedent's affairs, and his or her property is then distributed according to a formula fixed by law. After payment of taxes, debts, funeral expenses and administrative costs, the property goes to the surviving spouse, children or relatives. The laws are specific as to how property is to be distributed, including which relatives have priority and how the property is divided.

Funerals

A funeral is a procession or ceremony held in connection with the burial or cremation of a dead person. A funeral is an assortment of customs according to one’s religious affiliations and culture.
In the US and Canada, most funeral rituals are divided into three parts: visitation, funeral and burial. At the visitation ceremony, the embalmed body of the deceased is placed in a casket for friends and family to view the body. Usually, visitation takes place one or two evenings before the funeral, and most attendees sign a book kept by the deceased’s survivors to record the feelings of the friends and family members. Sometimes, a family might also display photographs taken of the deceased during his lifetime, or some prized possession at the visitation. The ceremony usually ends with a prayer service, and in a Catholic funeral the ceremony might include a rosary.

The visitation ceremony follows a memorial service or funeral service, and generally take place at either a funeral home or church. The funeral service is often officiated by a clergyman and includes prayers, reading from the Bible, the singing of hymns and words of comfort by the clergy. Sometimes a relative or close friend also gives a eulogy detailing happy memories and achievements. Finally, the coffin is closed after the attendees view the deceased's body for the last time. The funeral service is concluded with a burial service, conducted at the side of the grave, tomb or crematorium, where the body is being buried or cremated at the conclusion. Sometimes, pallbearers or close relatives and friends of the deceased carry the casket from the chapel to the hearse and from the hearse to the site of the burial service. In some traditions, a meal or other gathering at the deceased’s church or another off-site location follows the burial service.

Don't Wait Until a Death to "Balance the Checkbook"

Recently a friend died suddenly and his wife had never taken much interest in their family's financial situation. She figured that she had plenty of time to talk it over with her husband. They had briefly talked about going over their financial affairs but they never got around to it. After his death she had no clue how much insurance he had or where the IRA's and 401k's were located. The check book was even a mystery as she used a credit card for any purchases she had to make and her husband wrote out the checks and paid the bills. Several reoccurring bills were paid directly from the checking account and she didn't know the passwords to get into their on-line banking accounts.

After some study it was apparent she was not an isolated case. All too often women-and some men-leave the family finances to the other spouse. When the unexpected happens, death, disability or divorce the uninvolved spouse can be left with no clue as to the family's finances.

The problem, in most cases, would have been manageable if the spouses had discussed their finances. How to approach this can be difficult as the spouse managing the money may feel they are being criticized in their handling of the finances. The other spouse has to take some responsibility in this matter by asking questions and showing some interest. At the least women may have to know how to handle finances as many outlive their husbands, they never marry or they get divorced.

One suggestion is that the spouse who manages the money make up a folder for the other listing all the accounts, insurance policies, location of wills, and safety deposit boxes. It should be kept in a safe place and updated periodically. A listing of passwords for online accounts is also a good idea, although it should be kept separate from the listing of account numbers.

Another thought is for the managing spouse to allow the other to take a turn paying the bills and balancing the check book from time to time. Further, the family should update the family's assets, debts and other obligations at least once a year. If there are financial advisors involved both should meet with them periodically.

Now that she was alone it's still not too late to become knowledgeable in "balancing the checkbook." However, it could be a mistake trying to do everything at once. The first step is finding out what bills need to be paid and what income is available to pay them. She needs to find out what benefits continue or change after the spouse's death.

Funeral Planning is Important

None of us like to think about our loved ones passing on but the reality is that it will happen. The key is that you must be prepared for the complexities of finalizing someone’s life. There is a lot of money and planning that goes into a funeral and when we are in a depressed state is the last time we want to attempt to do it. Plan ahead and plan appropriately so that when the devastating news does come that is the only worry, not what to do about the funeral.

When planning a funeral there are a number of things to consider and it is all based off of budget. The first thing that you have to plan is where the deceased is going to be taken. The choosing of a funeral home is important since they will be paid a lot of money and they need to be trusted with the remains of your loved one. Research all facets of their business before finally deciding which one to use.

The next thing to do is to choose a casket. There are a million and one choices in the casket area which all depend on how fancy you want to go. There are caskets that are adorned with gold and other precious metals as well as the simple wooden ones. Feel free to purchase a nice one but do not spend more than you can afford since a person passing on is no reason to bankrupt yourself and make the rest of your life difficult. They would agree.

The last area of importance is the head stone. Choose a design and be happy with it since that is the easiest part. The engraving on the stone is the most important part. Think long and hard about what you want it to say since it will last forever. Involve many of the close relatives to see what they have to say. The more personal the better since this is going to be what everyone that visits the plot will read.

It is a hard thing but the more planning you do now the easier the time will be when you need it to be.

I Will Live On

I was recently looking around the internet for a funeral poem that had not already been massively overused. As I was unable to find one that expressed what I wanted to say, I decided to try and write one of my own and this is the result. I hope maybe that others may find it of some use in these difficult times.

Don’t cry for me in sadness, don’t weep for me in sorrow,
For I will live on beside you, as sure as comes tomorrow.
My body has gone but my spirit lives on, as does my love for you,
Just as in life, I’ll watch over you, I always will be true.
My blood lives on in my children, how I’ve watched them grow with pride,
I’ll live on within them, always by their side.
I know my jokes weren’t always funny and jobs weren’t always done,
Just try and remember the good times, the days when we had fun.
Reach out if you need me, for I always will be near,
Just talk to me, as if I am there, I promise I will hear.
For I’ll live on, within your mind, we’ll never be apart,
As long as you keep, my memory, deep within your heart.
So lift up your hearts, don’t be sad, my spirit hasn’t gone,

Asset Protection

It began coming into prominence in the late 1980s, with the advent and the marketing of offshore asset protection trusts. Depending on the creditor's intelligence and aggressiveness, timing, the debtor's risk-tolerance and other factors, the strategies discussed in this article may significantly tilt the economic equation in the debtor's favor. From a creditor's perspective, a successful fraudulent transfer challenge gives the creditor the legal right to pursue the transferred assets. Practitioners should keep in mind not only the underlying substantive law, but the obstacles presented to the creditor by the practical implications of asset protection planning. QPRTs are frequently used in estate planning and should be familiar to most estate planning attorneys. The focus of all asset protection planning is to remove the debtor from legal ownership of assets, while retaining the debtor's control over and beneficial enjoyment of the assets.


Legal Match

The debtor frequently remains in control of the entity and can defer distributions, the creditor has no way of enforcing the judgment against the debtor's LLC or limited partnership interest or the assets owned by these entities. Having a legal right to do something does not mean having the actual ability to do so, and does not mean that the pursuit of the transferred assets would be cost effective. Assets may be transferred into irrevocable trusts, sold for cash or on installment basis or encumbered. An alternative to an outright sale is the sale and leaseback of the residence to a friendly third-party on a deferred installment note. The charging order limitation limits a creditor's remedy to a lien against the distributions from the entity, without conferring on the creditor any voting or management rights. The final available alternative to protect a personal residence is by contributing the residence to a qualified personal residence trust ("QPRT").

A creditor may be able to make a successful legal argument that a given structure should not stand, and thus be able to retrieve the debtor's assets. The debtor has two asset protection choices:

(i) do nothing and stand to lose all assets when the plaintiff becomes a creditor, or
(ii) engage in some asset protection planning. Many debtors believe that simply moving money to an offshore bank account will serve as sufficient protection from creditors. Creditors do not want to play the waiting game, and would prefer to settle for a sum certain today, than wait for a possible distribution from an LLC or a limited partnership.

The three most important factors are:

(i) the identity of the creditor pursuing the client,
(ii) the nature of the assets that will be pursued by the creditor, and
(iii) the extent to which the debtor is willing to go to protect his assets. Given that the more favorable asset protection jurisdictions have a very short statute of limitation for bringing a fraudulent transfer action, require proof of intent beyond a reasonable doubt and require proof of debtor's insolvency, the creditor faces a daunting task.

If you are someone who wants real protection, a better option may be an irrevocable trust or an outright sale of the residence. A creditor's sole remedy would be to bring a fraudulent transfer action against the trustee of the foreign trust, and attempt to show that the settlement of the trust by the debtor constituted a fraudulent transfer. There is no "magic bullet" asset protection strategy; different structures are used to protect different types of assets. The specific structure best suited for each person will depend on the nature of the asset being protected. Practitioners should also consider the income tax consequences of the sale, and possible property tax consequences on the transfer of ownership. To an extent the debtor-settlor retains an interest in the trust, the trust will be deemed self-settled and will not offer the debtor any asset protection.
